How to File a Small Claims Case

Follow these steps to successfully file your small claims case in Mississippi Justice Court.

  1. Gather Required Documents

    Collect all relevant documents including contracts, receipts, photographs, and any written communications related to your case.

    • Original contract or agreement
    • Proof of payment or receipts
    • Photos of damage (if applicable)
    • Written correspondence

    Note: Make copies of all documents. Keep originals for court.

  2. Complete the Complaint Form

    Fill out the small claims complaint form with accurate information about your case and the defendant.

    • Your name and contact information
    • Defendant's name and address
    • Amount you're claiming
    • Brief description of the dispute
  3. File at the Courthouse

    Take your completed forms and documents to the Justice Court clerk's office in your county.

    Filing Fee: Typically $50-$100 depending on claim amount. Ask about fee waivers if you cannot afford the fee.

  4. Serve the Defendant

    The defendant must be officially notified of the lawsuit. The court will arrange service through the sheriff or process server.

    Important: You cannot serve the papers yourself. Service must be done by an authorized person.

  5. Prepare for Your Court Date

    Organize your evidence, practice your presentation, and arrive early on your court date.

    • Organize documents in chronological order
    • Prepare a brief statement of your case

    • Dress professionally and arrive 15 minutes early
